THIRD DISTRICT COURT: My Father and I met with Mr. Butterfield for trial but the Town of Huntington wanted to dismiss. Hon. Judge Mackenzie presided. We requested that the charges be withdrawn with prejudice so we wouldn't have to incur legal fees again. The Town opposed and the Judge instructed Mr. Butterfield and the Town Attorneys to meet to settle the sign ordeal.

SEPTEMBER 22ND, 2011 - APPEARANCE TICKET NOTICE FROM CODE ENFORCEMENT INSPECTOR - FELECIA
We recieved a ticket from Felecia stating we were in violation of Chapter 188 Section 188-3 ... "TRESPASSING ON TOWN PROPERTY" for a retaining wall and fence we installed on georgia street,

We spoke to Felecia and explained that the retaining wall was not on town property. We built the wall on our property. The existing fence and wall was falling down and we just installed new ones. She said that we are on town property and that we need to get a permit for the wall and fence. We told her that the wall was not more then 4 ft tall and she said that putting the fence on the wall makes it now higher then 4 ft. We need a "hold harmless agreement" from the "Town of Huntington" and must be signed by the William Naughton the Superintendent of Highways. We proceeded to get the documents signed and notorized and then on court date December 21st 2011 we handed all documentation to town attorney. The town attorney stated that all papers were in order and we should not be there and recommended case to be dismissed. She told Felecia that she will have to issue a new ticket for the wall and permit. Then we proceeded to go in front of the judge. He stated we will recieve an ACOD for the charges and will be on probation for 6 months. All to be dismissed if there is no more issues on this matter during probation.
